Dr. Evan Fleming is an uncooperative witness in the murder of Carl Mullaly by Hannah Welch.
History[]
Evan was an ER doctor who wasn't always home to raise his daughter Abigail as a single father. Welch came to their apartment building and slipped an anonymous note under the Flemings' door, with Abigail as the only witness. It said Mullaly, the father's and daughter's neighbor, which was a child predator, which, after the note was thrown out, motivated Evan to go to the daycare center Mullaly worked at and report it to the managers. Mullaly got into a shouting fight with one of the managers and was fired. Evan took Abigail to a therapist to get her evaluated, which determined she wasn't sexually assaulted much to Evan's relief. Evan wasn't surprised the reality show Hard Focus ousted Mullaly as a predator in a sting, which saw from the break room of his ER.
Abigail saw Welch run out of Mullaly's apartment shortly after the murder, recognizing her from when she left the note. Evan went to the apartment himself and found Mullaly stabbed to death inside. He made Abigail swear to say, like him, they never noticed anything that night when the police came to the door, then called for a food delivery so he wasn't the witness reporting to the cops. They told that story when the detectives arrived, with Abigail on Evan's shoulders. Evan told about his work shift and attributed to his lack of shock over Mullaly to his profession. However, Evan was found out to have reported Mullaly to the daycare, and he admitted he didn't want Welch arrested, offering even to buy her a steak when she was found.
Phone records for the delivery proved Evan's guilt in obstruction, and when threatened with 25 years in jail, he admitted he found Mullaly dead first after Abigail saw Welch flee. He doesn't want Abigail to testify, but she's brought in anyway to provide her account She reveals the description of the woman she saw, who fits Welch uncannily. Abigail identifies Welch in a lineup, leading to her arrest. It's unknown what penalties Evan faced for his attempts to bar the law and justice system. (L&O: "Public Service Homicide")
